These terms and conditions (“Terms”) apply to all orders placed through this website. Please read them carefully before placing an order. By completing a purchase you agree to be bound by these Terms.
This website is operated by Offstone Publishing Limited (“we”, “us”, “our”), a company registered in England and Wales under company number 07221034, with its registered office at C11 Marquis Court, Team Valley Trading Estate, Gateshead, Tyne & Wear, NE11 0RU. Our correspondence and returns address is PO Box 122, Prudhoe, NE42 9BA, United Kingdom. You can contact us at info@lakesandcumbriaguide.co.uk.
These Terms, together with our Privacy Policy and any other policies referred to in them, form the entire agreement between you and us for the supply of our products, and supersede any earlier terms. Headings are for convenience only. We may update these Terms from time to time, and the version that applies to your order is the one published on this website at the time you place it.
We sell the Lakes & Cumbria Guide in two formats: a printed magazine, posted to a UK delivery address, and a digital edition, supplied as a PDF download delivered by email. We take care to describe and show the products accurately. Printing and screen display can cause minor variations in colour, and page counts and content relate to the issue described at the time of sale.
Placing an order is an offer to buy. Your order is accepted, and a contract is formed, only when we send you an order confirmation. For print, this is normally when we dispatch your copy; for digital, when we email your download. If we cannot accept your order, we will tell you and will not charge you, or will refund any payment taken.
We may decline or cancel an order, for example if the product is unavailable, if there has been a pricing or description error, or if we suspect fraudulent activity.
Prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery charges, where they apply, are shown separately at checkout before you confirm your order. Payment is taken securely at checkout, and we do not store your full card details. Prices may change from time to time, but changes will not affect orders we have already accepted.
You agree to provide current, complete and accurate purchase and account information for every order, and to keep it up to date so that we can complete your transactions and contact you where needed. We reserve the right to refuse or cancel any order, and to limit or prohibit orders that, in our reasonable judgement, appear to be placed for resale or by dealers or distributors. Where we change or cancel an order, we will try to contact you using the details provided at the time of the order.
We post printed copies to UK addresses using Royal Mail. Delivery options and costs are calculated at checkout based on the service you select, and a small handling charge may be included to cover postage and packaging materials. We aim to dispatch within a few working days of your order. Delivery times quoted are estimates and are not guaranteed. Risk in the goods passes to you on delivery. If an item has not arrived within a reasonable time, please contact us and we will help resolve it.
The digital edition is delivered by email as a download link or attachment, normally immediately or shortly after payment. The link is for your personal use. If you do not receive your download, please check your spam folder and then contact us.
If you are a consumer, under the Consumer Contracts Regulations 2013 you have the right to cancel a printed order within 14 days of receiving it, without giving a reason. To cancel, contact us at orders@lakesandcumbriaguide.co.uk before the 14 days expire.
You must return the item to us in resaleable condition within 14 days of telling us you wish to cancel. You are responsible for the cost of return postage unless the item is faulty or was sent in error. We will refund the price you paid, including standard outbound delivery, within 14 days of receiving the returned item or proof that you have sent it back.
Because the digital edition is supplied as a download, your right to cancel ends once the download has begun. By purchasing the digital edition and accessing your download, you expressly consent to immediate supply and acknowledge that you lose the right to cancel once the download starts. We therefore do not offer refunds on digital editions once downloaded, except where the file is faulty or not as described.
Nothing in these Terms affects your legal rights. Under the Consumer Rights Act 2015, products must be as described, fit for purpose and of satisfactory quality. If your printed copy arrives damaged or faulty, or your digital file does not work, contact us at orders@lakesandcumbriaguide.co.uk within a reasonable time and we will arrange a replacement or refund. Please keep any damaged packaging where possible, as it helps us with the carrier.
Where a refund is due, we make it using the same payment method you used to pay, unless agreed otherwise. Refunds are processed promptly and in any event within the timeframes set out above.
Occasionally information on our site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, offers, delivery charges or availability. We reserve the right to correct any such errors and to change or update information, and to cancel an order if any information was inaccurate, including after you have submitted your order. If a price is clearly wrong and you could reasonably have recognised it as an error, we are not obliged to supply the product at the incorrect price. Where we cancel an order for this reason, we will refund any payment taken in full.
All content in the guide, including text, photography, design and layout, is the copyright of Offstone Publishing Limited or its contributors. You may not copy, reproduce, redistribute, resell or publish any part of the printed or digital edition without our prior written permission. The digital edition is licensed to you for personal, non-commercial use only and may not be shared or forwarded.
You may use this website and our products only for lawful purposes. You must not use them in any way that breaches any applicable law, is fraudulent or harmful, or seeks to damage, disrupt or gain unauthorised access to the website or any server or network connected to it. You must not transmit any viruses or other malicious code, nor attempt to scrape, harvest or collect data from the site without our permission. We may suspend or withdraw your access to the website if you breach these Terms.
Our website and the guide may include links to, or content from, third-party websites and services that are not controlled by us. We provide these for information only and are not responsible for their content, accuracy or practices. Any dealings you have with a third party are between you and that third party, and we recommend you review their own terms and privacy policies.
If you send us reviews, comments, ideas or other materials, whether by email, post or through the website, you grant us permission to use, edit, copy, publish and distribute them in any medium without obligation to keep them confidential, pay for them or respond. You are responsible for the accuracy of anything you submit, and you must not submit material that is unlawful, defamatory, infringes anyone’s rights, or contains malicious code. We may remove any submitted content at our discretion.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not foreseeable, or for business losses, as our products are supplied for private use. Nothing in these Terms affects your statutory rights as a consumer.
We handle your personal data in line with our Privacy Policy, which explains what we collect and how we use it. Please read it alongside these Terms.
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
These Terms are governed by the law of England and Wales, and any disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.
